The Trademark Law of the People's Republic of China
Article 1 This Law is formulated in order to protect the exclusive right to use a trademark and to encourage producers and operators to guarantee the quality of their goods and services, and maintain the reputation of their trademarks, so as to protect the interests of consumers and promote the development of the socialist market economy.
Article 2 The exclusive right to use a trademark is protected by law in the People's Republic of China.
Any natural person, legal person or other organization that engages in production or provision of services may apply to register trademarks used in their business operations. The Trademark Office under the State Administration for Industry and Commerce shall be responsible for the registration and administration of trademarks.
Article 3 A registered trademark shall be a mark that is capable of distinguishing the goods or services of one natural person, legal person or other organization from those of others. Such marks may consist of words, designs, letters, numerals, three-dimensional signs, color combinations, and the combination of the above elements.
Article 4 The principle of good faith shall be upheld in the application for trademark registration and the use of trademarks.
Article 5 The registration and use of trademarks shall not infringe upon the existing prior rights of others, nor be detrimental to social public interests.
Article 6 Any natural person, legal person or other organization that is engaged in the production or business operation of goods or the provision of services shall have the right to apply to register trademarks used in their business operations.

Article 11 Except where the prior right of another person exists, the Trademark Office shall approve the registration of a trademark for which application is filed, issue the certificate of trademark registration, and announce it.

Article 44 Where the exclusive right to use a registered trademark is infringed upon, the infringed party shall have the right to request the infringer to bear civil liabilities in accordance with the law.

Article 57 This Law shall come into effect as of March 1, 1983. The "Regulations on Trademark Registration of the People's Republic of China" promulgated by the State Council on April 10, 1963 shall be repealed simultaneously.
